Privacy Policy

Introduction 

Welcome to the websites of Medical Staff Holdings and its subsidiaries (collectively “MSH” or “we”). MSH respects your privacy and is committed to protecting it through our compliance with this policy, while providing you with a useful and enjoyable web experience.   

This policy covers any company that is owned by MSH.  It does not cover MSH clients or subcontractors – they will have separate practices regarding your personal information, and you should refer to their websites or policies for more details.   

This policy describes the types of information we may collect from you or that you may provide when you visit the websites: medicalstaff.holdings.com, medicalstaffholdings.com, nurse2nursestaffing.com, tlctravelstaff.com, mynela.com, radlinkstaffing.com, lighthousenursing.com or any other website owned or operated by MSH (collectively, “MSH Sites”) and our practices for collecting, using, maintaining, protecting and disclosing that information. 

This policy applies to information we collect on the MSH Sites or in email, text, and other electronic messages between you and the MSH Sites.  This policy does not apply to information collected in any other way (whether offline or online) by MSH, unless expressly indicated, nor does it apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from or through the MSH Sites.  

In this privacy policy we will tell you how we handle your personal information, both online and offline, when you apply for a job, through the course of your employment, or if you visit the MSH Sites.  Please read this policy carefully to understand our practices and policies regarding your information and how we will treat it. If you do not agree with our practices and policies, your choice is not to use the MSH Sites. By accessing or using the MSH Sites, you agree to this policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the MSH Sites after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates. 

Information We Collect About You and How We Collect It 

We collect several types of information from and about users of the MSH Sites, including: 

  • Contact Information. We may collect contact and other information about you, including your name, address, telephone number and email address, as well as contact information of your dependents, beneficiaries, or emergency contacts. 

  • Employment and Demographic Information. We may collect licensure, certifications, education, demographic information, employment history, and identification numbers, such as your social security number, date of birth, driver’s license number, state identification card, or passport number. Employees and applicants may use our secure application portals to submit additional information related to employment opportunities with us, including necessary credentialing information and documentation, which may include drug screen results, background check information, employment eligibility information, self-assessment of skills and qualifications, skills checklist,  name and contact information of references you provide, and health and medical information. 

  • Financial Information. We may collect certain financial information, including bank account numbers and routing numbers from employees and other individuals, such as vendors and independent contractors, for payment purposes. 

  • Communications. If you have created a profile on any of the MSH Sites, we may collect the contents of written communications between you and MSH. 

Aside from any information you may actively disclose to us as you navigate through and interact with the MSH Sites, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including: 

  • Details of your visits to the MSH Sites, including traffic data, location data, logs, and other communication data and the resources that you access and use on the MSH Sites. 

  • Information about your computer and internet connection, including your IP address, operating system, browser type, CPU speed, click patterns and browser type. 

We may use the information we collect automatically for internal purposes such as to improve the content of the MSH Sites, estimate our audience size and usage patterns, store information about  your preferences, and to deliver a better and more personalized service by, for example, speeding up your searches and recognizing when you return to the MSH Sites. 

The technologies we use for this automatic data collection may include: 

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the MSH Sites. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the MSH Sites.  

  • Web Beacons. Pages of the MSH Sites and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit MSH, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).  

  • Flash Cookies. Certain features of the MSH Sites may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on the MSH Sites. Flash cookies are not managed by the same browser settings as are used for browser cookies. Your information will be stored indefinitely, so that MSH can comply with legal, regulatory, and accounting obligations. 

How We Use Your Information  

We use information that we collect about you or that you provide us, including any personal information: 

  • To present the MSH Sites and their contents to you. 

  • To provide you with information, products, or services that you request from us. 

  • To perform, monitor or improve our services. 

  • To manage our relationship with you. 

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and MSH, including for billing and collection. 

  • To notify you about changes to the MSH Sites or any products or services we offer or provide though them.  

  • To carry out marketing activities. 

  • To investigate potential fraud, including to detect and investigate security incidents. 

  • To investigate violations of this policy or any other agreement MSH has with you. 

  • To evaluate your credentials, skills, and experience in order to decide whether to extend a job offer. 

  • To provide you with information regarding employment opportunities and career-related information. 

  • In any other way we may describe when you provide the information. 

Disclosure of Your Information 

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. 

We may disclose personal information that we collect or you provide as described in this privacy policy: 

  • To our subsidiaries and affiliates.  

  • To contractors, service providers, and other third parties that we use to support our business, such as hosting our web servers, providing marketing assistance and tools, payment processing, and customer service.  

  • To our clients, customers, and vendors, including employment-related information, as permitted by law. 

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our business assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.

  • To fulfill the purpose for which you provide it.  

  • For any other purpose disclosed by us when you provide the information. 

  • With your consent. 

We may also disclose your personal information: 

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request. 

  • To enforce or apply our terms of use http://www.tlctravelstaff.com/terms and other agreements, including for billing and collection purposes. 

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of MSH, its subsidiaries and affiliates, customers, or others.  

Choices About How We Use and Disclose Your Information  

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information: 

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s website. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly. 

  • Opting-Out.  If you do not wish to have your personal information, including your email address used for marketing or other similar purposes, you may stop that use by emailing your request to privacy@medicalstaffholdings.com or unsubscribing using the link located at the bottom of our marketing emails. Please include “Unsubscribe” in the Subject line of your email. 

Obtaining Your Consent 

By using the MSH Sites, you give MSH permission to collect information about you as an anonymous user for the purpose of calculating aggregate site statistics. If you register on one of the MSH Sites, you authorize MSH to use information you provide to us to personalize your experience. If you register on one of the MSH Sites, you also authorize MSH to use your anonymized demographic information when calculating aggregate customer data. As a registered member, you give MSH and its agents permission to send you e-mails related to the services we offer. 

Minors 

MSH Sites are not intended for children under 18 years of age. No one under age 18 may provide any personal information to or on the MSH Sites. We do not knowingly collect personally identifiable information from individuals under the age of 18.  If you are under 18, do not use or provide any information on the MSH Sites or through any of its features, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. You, or a parent or guardian of a minor, may ask us to remove certain content or information by emailing us at privacy@medicalstaffholdings.com.   

Accessing and Correcting Your Information 

We encourage you to correct and update your personal information by updating it in your online profile. You may also request corrections and updates to your personal information by emailing privacy@medicalstaffholdings.com. Upon your request, we will provide you with any unique identifying or personal information that we maintain about you as required by law and will make any appropriate changes you provide.  We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.  Residents of certain states, such as California and Nevada may have additional personal information rights and choices. Your State Privacy Rights 

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. 

  • California Residents’ Privacy Rights.  If you are a California resident, the processing of certain personal data about you may be subject to the California Consumer Privacy Act (“CCPA”) and other applicable privacy laws. 

If you are a California resident, you have the right, subject to certain exceptions and other laws, to request information regarding MSH’s collection, use and disclosure of your personal information over the past twelve (12) months. You also have the right to request that we delete certain information. MSH may deny your request to delete, in accordance with the CCPA, in order to comply with its other legal, regulatory, and accounting obligations. 

To request what information MSH has collected or shared about you, or to request that MSH delete your information, please send an email with the subject line, “California Privacy Rights” to privacy@medicalstaffholdings.com or call us toll free at 1-888-382-2799. In the body of your email or in your voice message, please state your first name, last name, mailing address, email address and telephone number. We will use this data to locate your profile within our system. If you are a California resident, MSH will respond in accordance with the CCPA and related regulations. If you are not a California resident, you do not have any rights under the CCPA and your request may be denied. 

If an authorized agent of a consumer submits a request to know or request to delete, the agent must submit a writing to MSH that is signed and dated by the consumer. The consumer’s first name, last name, mailing address, email address, and telephone number must be included on the signed authorization. The signed authorization must expressly state that the agent is authorized to submit requests to know and requests to delete on the consumer’s behalf, receive the consumer’s personal information in response to a request to know, and to receive communications on the consumer’s behalf related to the requests. 

You will not receive discriminatory treatment or retaliation if you or your authorized agent exercise your rights under the CCPA. 

Under the CCPA, we are required to tell you if we “sell” or “share” information. A “sale” means to share with a third party for monetary or other valuable consideration. “Share” means to share with a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration. Please note we do not currently “sell” or “share” your personal information. 

  • Nevada Residents.  Nevada provides its residents with a limited right to opt-out of certain personal information sales. Nevada residents may email questions or opt out of any future sale of their information by emailing us at privacy@medicalstaffholdings.com. Please include “Nevada Privacy Rights” in the Subject line of your email.  However, please note we do not currently sell data triggering that statute’s opt-out requirements. 

 

  • Colorado, Connecticut, Virginia, and Utah Residents.   Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to confirm whether we process their personal information, access and delete certain personal information, and opt-out of personal data processing for targeted advertising and sales.  Colorado, Connecticut, and Virginia also provide their state residents with rights to correct inaccuracies in their personal information, taking into account the information’s nature processing purpose, and opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

In the body of your email please state your first name, last name, mailing address, email address and telephone number. We will use this data to locate your profile within our system. 

Data Security 

Security is a top priority for us.  We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.  The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the MSH Sites, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.  

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to the MSH Sites. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the MSH Sites.  Our policy does not extend to anything that is inherent in the operation of the Internet, and therefore beyond our control, and is not to be applied in any manner contrary to applicable law or governmental regulation.
